Within the framework of our business relationship we consider ourselves to be obliged to guarantee your personal rights. Therefore, the following data protection declaration applies. This declaration describes (a) what personal data are; (b) which type of personal data may be collected from you; (c) how, when and where we may collect these data; (d) how we may use these data; (e) whether we may forward these to third parties; (f) which measures we will take in order to guarantee the security of your data and (g) your rights relating to our handling of your personal data. Above all it describes (h) Your possibility for making decisions with regard to the use of your personal data by Amway.

BY USING THIS WEBSITE AND ACCEPTING THE CONDITIONS FOR USE ON THIS WEBSITE YOU DECLARE YOUR EXPLICIT CONSENT TO THE COLLECTION, STORAGE, TRANSMISSION AND USE OF YOUR PERSONAL DATA AS DESCRIBED IN THIS DECLARATION.

Should you have objections at any time against the fact that we use your personal data, you can contact Amway and inform that Amway may no longer use your data. We request you to send us a written notification of your concern and will refrain from all use of your data immediately in line with your request.

If you have any questions with regard to this data protection declaration please direct these to your Amway branch.

(A) Personal data are specifically information, which let Amway know who you are, such as for example your name. These can also include information which solely serves the purpose that Amway can determine based who you are upon this. It can concern here your address, telephone number and date of birth.

(B) With your consent (which is carried out by using the contact form on the website) we may occasionally collect the following personal data, in addition to your other data

(C) We will not deliberately collect data of minors. Should we determine that we have collected data of minors by mistake we will delete these from our database immediately.

(D) Your IP address will be visible for Amway as soon as you visit our website. An IP address is a number which is automatically allocated to your computer as soon as you are connected with the Internet. Your IP address is accessible to the majority of websites which you visit. We only use IP numbers in order to determine interferences on our websites, to create and record statistics about the use of the website.

You can principally contact Amway by visiting this website without informing Amway who you are or disclosing any personal data, except your IP address. You can however voluntarily make your personal data available for the use of the contact form in order to contact Amway so that your inquiries or concerns can be answered. In such cases we could store a recording of your contact, including relevant personal data, in a file folder which was set up especially for you or for similar contact inquiries.

If you contact Amway on the website we will use Cookies. Cookies are data folders which are stored on your computer. They can contain information which makes it possible for a website provider to identify when a user visits the website, how the user acts on the website and to record how regularly they return.

When you enter the website the server attaches a small text file on your hard disk – this is a cookie.

We can also use cookies in order to see and record how you use the website.

(D) Cookies cannot be carried out as a code or used for transmitting viruses. Other providers can neither read these nor remove personal information. These merely serve as identifiers between you and Amway; we do not inform anyone of these outside of Amway, the Amway branches and third parties listed above.

The website uses neither Active-X nor Java applets.

(E) The personal data, which we record from you, will not be used by us for any other purposes than as intended.

(F) Amway will neither forward, sell, nor rent your data nor trade with them. Amway shall not forward your data to third parties as long as it is not necessary by law and appropriate in order for Amway to be able to satisfy its business obligations or satisfy its obligations towards you. We shall reach an agreement with all third parties, to whom we are able to notify of your personal data, that your data are treated confidentially in line with this data protection declaration and the applicable laws. Our contracts with third parties regulate that your personal data are only used for the respective purposes stipulated in the contract. Therefore, these contracts have no further purpose than that, for which we use your personal data within the afore-mentioned meaning. Third parties are not permitted to use your personal data for own purposes. Third parties are further not permitted to forward your personal data on the other hand to other third parties unless this is necessary for the satisfaction of contractual purposes with Amway.

In addition, we can forward part or the whole stocks of your personal data to third parties with whom we do not maintain any contractual relationship insofar as we are obliged hereto by law. We further reserve the right to report those activities to criminal prosecution authorities which we consider to be unlawful. Finally we can also use personal data towards third parties if we may reasonably assume that it is necessary in order to protect the rights, the property and the safety of others or of us.

(G) It goes without speaking that we are not responsible for the handling of third parties with your personal data if these obtain access or connection to our information, materials, products and/or services. It is your responsibility to check these third parties for their data protection measures.

(H) We will store personal data in our databases, which are maintained by Amway in Europe or in our head office in the United States of America. We will in addition not transmit any personal data outside of the European Union. Insofar as we make these available to our sister companies or other parties this is always carried out by complying with security standards, which Amway safeguards towards you.

Electronic databases are maintained in safe and independent servers which are located in guarded and secure rooms. Electronically stored personal data are backed up periodically. The backed up data are stored in a further guarded and secure room. Electronically stored personal data are exclusively accessible by Amway employees or persons commissioned by Amway, sister companies, subsidiaries and/or special Amway departments and third parties which log-in with an approved Log-In-ID and an approved password. Insofar as required by law the technical and organizational minimum security standards are to be complied with by this group of persons.

Documents with personal data are stored in a safe location or in a filing cabinet at Amway. Such rooms or filing cabinets are locked if they are not just being used. The access to these rooms and/or the access to the filing cabinets are limited to those persons whose employment at Amway requires such an entrance or access.

(I) In addition to your rights regulated in this data protection declaration you have the following further rights with regard to your personal data:

Access and correction of your personal data: We are responsible for the processing of your data. Insofar as you are entitled to the right according to applicable law you have access to your personal data stored in our company and the right to correction or deletion of your personal data. In order to enable you to exercise this right we need a written application from you with regard to your personal data. We can also send you questionnaires and notifications which contain certain personal data which you can then check and correct. In the end all documents, which we send to you in the course of the customary business process and which contain your personal data, require your examination in order for their accuracy to be guaranteed. Should your personal data be incorrect, please complete the form concerning the change of personal data and send this to Amway by post or by fax, at the address given on the form.

Deletion of your personal data after termination: You are entitled to request the deletion of your personal data from our database within a reasonable period of time when they have satisfied their purpose. As a rule we ensure that personal data are deleted from our database within three (3) months after your inquiry. Unless there is an ongoing business reason which initiates us to store these for a longer period of time.

(K) We will if applicable adjust this data protection declaration occasionally insofar as we are obliged by virtue of law or owing to our internal processes. Please check our data protection measures regularly.
